為(wei)加快建設高效規(gui)范(fan)、公(gong)平競(jing)爭、充分(fen)開放的統一大市(shi)場,自(zi)治區住房和城鄉建設廳對(dui)現(xian)行有效的行政規(gui)范(fan)性(xing)文件(jian)進行了清(qing)理。經(jing)過研究,決定(ding)修(xiu)改(gai)10件(jian),廢(fei)止(zhi)12件(jian)行政規(gui)范(fan)性(xing)文件(jian)。具體如(ru)下:
一、決定修改的文件
(一)關于印發(fa)《寧夏房屋(wu)建筑與市政工程建設單位首要責(ze)任(ren)管(guan)理規定》的通知(zhi)(寧建規發(fa)〔2022〕1號)
第十二條“建設(she)(she)(she)單位要(yao)(yao)在(zai)(zai)住(zhu)宅(zhai)工(gong)(gong)(gong)程(cheng)(cheng)建設(she)(she)(she)全過程(cheng)(cheng)落(luo)實(shi)(shi)住(zhu)宅(zhai)工(gong)(gong)(gong)程(cheng)(cheng)質(zhi)量(liang)信(xin)息公示(shi)制度,應在(zai)(zai)售(shou)樓部(bu)明顯位置以觸摸式電子屏和櫥(chu)窗展(zhan)示(shi)形式對施(shi)工(gong)(gong)(gong)許(xu)可、主要(yao)(yao)使(shi)用材料及工(gong)(gong)(gong)藝(yi)做(zuo)(zuo)法等信(xin)息進(jin)行(xing)公示(shi)。按照戶型類型在(zai)(zai)售(shou)樓部(bu)或(huo)施(shi)工(gong)(gong)(gong)現場設(she)(she)(she)置1:1實(shi)(shi)體交付(fu)(fu)樣板(ban),其(qi)標準需同(tong)實(shi)(shi)際(ji)相符(fu)”,修(xiu)改為:“建設(she)(she)(she)單位要(yao)(yao)在(zai)(zai)住(zhu)宅(zhai)工(gong)(gong)(gong)程(cheng)(cheng)建設(she)(she)(she)全過程(cheng)(cheng)落(luo)實(shi)(shi)住(zhu)宅(zhai)工(gong)(gong)(gong)程(cheng)(cheng)質(zhi)量(liang)信(xin)息公示(shi)制度,應對工(gong)(gong)(gong)程(cheng)(cheng)規劃許(xu)可、施(shi)工(gong)(gong)(gong)許(xu)可、工(gong)(gong)(gong)程(cheng)(cheng)結構形式、設(she)(she)(she)計使(shi)用年(nian)限(xian)、參建單位及項(xiang)目(mu)負(fu)責(ze)(ze)人信(xin)息、質(zhi)量(liang)承諾書、工(gong)(gong)(gong)程(cheng)(cheng)竣工(gong)(gong)(gong)驗收報告、主要(yao)(yao)使(shi)用材料及工(gong)(gong)(gong)藝(yi)做(zuo)(zuo)法、質(zhi)量(liang)保(bao)修(xiu)負(fu)責(ze)(ze)人及聯系(xi)方(fang)式等信(xin)息進(jin)行(xing)公示(shi)。在(zai)(zai)交付(fu)(fu)實(shi)(shi)體上(shang)設(she)(she)(she)置實(shi)(shi)體交付(fu)(fu)樣板(ban),其(qi)標準需同(tong)實(shi)(shi)際(ji)相符(fu)”。
(二)關于(yu)印發《寧(ning)夏回族自治區建筑工程施工現場(chang)關鍵崗位人員配備(bei)管理辦法》的通知(寧(ning)建規發〔2022〕2號)
1.第六條第二(er)款“被鎖(suo)定(ding)(ding)人員(yuan)(yuan)(yuan)信息通(tong)過寧(ning)夏建(jian)筑市(shi)場監(jian)(jian)管(guan)(guan)(guan)服(fu)務系統向(xiang)行(xing)(xing)政(zheng)(zheng)審(shen)批(pi)、招投(tou)標監(jian)(jian)管(guan)(guan)(guan)部(bu)門(men)推送。行(xing)(xing)政(zheng)(zheng)審(shen)批(pi)部(bu)門(men)在(zai)辦理人員(yuan)(yuan)(yuan)變(bian)更注冊時,可登錄(lu)寧(ning)夏建(jian)筑市(shi)場監(jian)(jian)管(guan)(guan)(guan)服(fu)務系統查詢變(bian)更人員(yuan)(yuan)(yuan)鎖(suo)定(ding)(ding)情(qing)況”,修改為(wei)“被鎖(suo)定(ding)(ding)人員(yuan)(yuan)(yuan)信息通(tong)過寧(ning)夏建(jian)筑市(shi)場監(jian)(jian)管(guan)(guan)(guan)服(fu)務系統向(xiang)行(xing)(xing)政(zheng)(zheng)審(shen)批(pi)、招投(tou)標監(jian)(jian)管(guan)(guan)(guan)部(bu)門(men)推送。行(xing)(xing)政(zheng)(zheng)審(shen)批(pi)部(bu)門(men)在(zai)辦理人員(yuan)(yuan)(yuan)變(bian)更注冊時,可登錄(lu)寧(ning)夏建(jian)筑市(shi)場監(jian)(jian)管(guan)(guan)(guan)服(fu)務系統查詢人員(yuan)(yuan)(yuan)鎖(suo)定(ding)(ding)情(qing)況”。
2.第十一條“變(bian)更(geng)(geng)(geng)后(hou)的施工項目(mu)部(bu)、現(xian)場(chang)監(jian)理(li)部(bu)關鍵崗位(wei)人(ren)(ren)員的資(zi)(zi)(zi)格(ge)認(ren)證專業應與變(bian)更(geng)(geng)(geng)前(qian)(qian)(qian)人(ren)(ren)員相同(tong),執(zhi)(zhi)業資(zi)(zi)(zi)格(ge)等(deng)(deng)(deng)級(ji)不(bu)(bu)得(de)低于變(bian)更(geng)(geng)(geng)前(qian)(qian)(qian)人(ren)(ren)員執(zhi)(zhi)業資(zi)(zi)(zi)格(ge)等(deng)(deng)(deng)級(ji),關鍵崗位(wei)人(ren)(ren)員變(bian)更(geng)(geng)(geng)的數量不(bu)(bu)得(de)超過中標通知書人(ren)(ren)員的30%。辦(ban)理(li)人(ren)(ren)員變(bian)更(geng)(geng)(geng)手續期間(jian),應由(you)同(tong)等(deng)(deng)(deng)及(ji)以上資(zi)(zi)(zi)格(ge)的人(ren)(ren)員頂崗,項目(mu)現(xian)場(chang)不(bu)(bu)能出(chu)(chu)現(xian)管(guan)(guan)理(li)缺位(wei)”,修改為“變(bian)更(geng)(geng)(geng)后(hou)的施工項目(mu)部(bu)、現(xian)場(chang)監(jian)理(li)部(bu)關鍵崗位(wei)人(ren)(ren)員的資(zi)(zi)(zi)格(ge)認(ren)證專業應與變(bian)更(geng)(geng)(geng)前(qian)(qian)(qian)人(ren)(ren)員相同(tong),執(zhi)(zhi)業資(zi)(zi)(zi)格(ge)等(deng)(deng)(deng)級(ji)不(bu)(bu)得(de)低于變(bian)更(geng)(geng)(geng)前(qian)(qian)(qian)人(ren)(ren)員執(zhi)(zhi)業資(zi)(zi)(zi)格(ge)等(deng)(deng)(deng)級(ji)。辦(ban)理(li)人(ren)(ren)員變(bian)更(geng)(geng)(geng)手續期間(jian),應由(you)同(tong)等(deng)(deng)(deng)及(ji)以上資(zi)(zi)(zi)格(ge)的人(ren)(ren)員頂崗,項目(mu)現(xian)場(chang)不(bu)(bu)能出(chu)(chu)現(xian)管(guan)(guan)理(li)缺位(wei)”。
3.第(di)十二條(tiao)第(di)一款(kuan)“施(shi)(shi)工(gong)(gong)總承包(bao)(bao)企(qi)業(ye)完成合同約(yue)定內容并征(zheng)得(de)(de)監理、建(jian)設(she)單位(wei)同意后,可(ke)以(yi)撤(che)(che)離施(shi)(shi)工(gong)(gong)項(xiang)目部(bu)關(guan)鍵崗位(wei)人員(yuan)。施(shi)(shi)工(gong)(gong)總承包(bao)(bao)企(qi)業(ye)應在建(jian)筑工(gong)(gong)程(cheng)實名(ming)制系統(tong)中提交施(shi)(shi)工(gong)(gong)項(xiang)目部(bu)關(guan)鍵崗位(wei)人員(yuan)撤(che)(che)離申請,并附(fu)《工(gong)(gong)程(cheng)竣工(gong)(gong)報告》。對(dui)(dui)(dui)符(fu)合撤(che)(che)場條(tiao)件的,屬地住房(fang)城(cheng)鄉建(jian)設(she)主管部(bu)門應在5個工(gong)(gong)作日對(dui)(dui)(dui)鎖定人員(yuan)進行解鎖”,修改為“施(shi)(shi)工(gong)(gong)總承包(bao)(bao)企(qi)業(ye)完成合同約(yue)定內容并征(zheng)得(de)(de)監理、建(jian)設(she)單位(wei)同意后,可(ke)以(yi)撤(che)(che)離施(shi)(shi)工(gong)(gong)項(xiang)目部(bu)關(guan)鍵崗位(wei)人員(yuan)。施(shi)(shi)工(gong)(gong)總承包(bao)(bao)企(qi)業(ye)應在建(jian)筑工(gong)(gong)程(cheng)實名(ming)制系統(tong)中提交施(shi)(shi)工(gong)(gong)項(xiang)目部(bu)關(guan)鍵崗位(wei)人員(yuan)撤(che)(che)離申請。對(dui)(dui)(dui)符(fu)合撤(che)(che)場條(tiao)件的,屬地住房(fang)城(cheng)鄉建(jian)設(she)主管部(bu)門應在5個工(gong)(gong)作日對(dui)(dui)(dui)鎖定人員(yuan)進行解鎖”。
4.刪去附件1-1、附件1-2關于總人數和施(shi)(shi)工(gong)員(yuan)(yuan)、質(zhi)量(liang)員(yuan)(yuan)配(pei)備要求以(yi)及“10萬平方(fang)米以(yi)上(shang)的(de)房屋建(jian)筑工(gong)程,建(jian)筑面積(ji)每增加5萬平方(fang)米或工(gong)程合同(tong)(tong)價1.5億(yi)元以(yi)上(shang)的(de)市政工(gong)程工(gong)程合同(tong)(tong)價每增加5000萬元,施(shi)(shi)工(gong)項目部應增配(pei)1名專職(zhi)安全生產(chan)管理人員(yuan)(yuan)”的(de)內容。備注修改為“施(shi)(shi)工(gong)員(yuan)(yuan)、質(zhi)量(liang)員(yuan)(yuan)按中標(biao)通(tong)知書(報(bao)備告知書)或施(shi)(shi)工(gong)合同(tong)(tong)要求配(pei)備”。
(三)關于修訂《寧(ning)夏回(hui)族自(zi)治區(qu)房屋建(jian)筑(zhu)和市(shi)政基(ji)礎(chu)設施工(gong)程(cheng)施工(gong)圖設計文件審查管理(li)實施細則(ze)》的通(tong)知(zhi)(寧(ning)建(jian)規發〔2022〕4號(hao))
刪去(qu)第十八條第(三)項“審查人員存(cun)在(zai)以下情形之一的(de),由自治區(qu)住(zhu)房城(cheng)鄉(xiang)建(jian)設主管(guan)部門(men)依法予以處理,不得從事(shi)審查工作:(三)一年內被各級住(zhu)房城(cheng)鄉(xiang)建(jian)設主管(guan)部門(men)累計處理三次及以上的(de)”內容(rong)。
(四)關(guan)于印發(fa)《寧夏(xia)回族(zu)自治區房屋(wu)建(jian)筑和市政基(ji)礎設施工程招標代理機(ji)構從(cong)業人員執業行(xing)為記分管理實施細則(ze)(試行(xing))》的通知(寧建(jian)規發(fa)〔2022〕8號)

(五)關于印發《寧夏建筑施工項目“四大員”質量安全違法違規行為記分管理規定(試行)》的通知(寧建<建>;發〔2017〕13號)
“四(si)(si)、項目(mu)‘四(si)(si)大(da)員’在一個記分(fen)周(zhou)期(qi)內累積(ji)記分(fen)達到12分(fen)的(de),不應繼(ji)續從事項目(mu)管理崗位(wei)工(gong)作,接受住房城(cheng)鄉(xiang)(xiang)建設主管部門組(zu)織的(de)工(gong)程質量和安全(quan)(quan)生(sheng)產(chan)強制(zhi)性培訓、考試,合(he)(he)格后方可重新上崗。項目(mu)‘四(si)(si)大(da)員’在培訓教育期(qi)間,施工(gong)單位(wei)應當按(an)規定程序更換符合(he)(he)條件(jian)的(de)項目(mu)‘四(si)(si)大(da)員’”,修改為“四(si)(si)、項目(mu)‘四(si)(si)大(da)員’在一個記分(fen)周(zhou)期(qi)內累積(ji)記分(fen)達到12分(fen)的(de),接受住房城(cheng)鄉(xiang)(xiang)建設主管部門組(zu)織的(de)工(gong)程質量和安全(quan)(quan)生(sheng)產(chan)培訓、考試”。
(六)關于印發《寧夏集中供熱申請停暖和恢復用熱實施細則(修訂)》的通知(寧建<城>;發〔2016〕3號(hao))
