關于進一步加強房屋(wu)建筑和市政(zheng)工程施(shi)工許(xu)可管理的通知(zhi)

各(ge)市、州、直管(guan)市、神農架林(lin)(lin)區自然(ran)資(zi)源(yuan)和(he)城(cheng)鄉建設局(ju)、住房和(he)城(cheng)市更(geng)新(xin)局(ju)、城(cheng)管(guan)委(局(ju)),武漢(han)市園(yuan)林(lin)(lin)和(he)林(lin)(lin)業(ye)局(ju)、水務局(ju),宜昌市林(lin)(lin)業(ye)和(he)園(yuan)林(lin)(lin)局(ju),襄陽市、十堰市、荊門(men)市行政審批局(ju):

為(wei)有效遏制房屋建筑(zhu)和(he)市政工(gong)(gong)程“無(wu)證(zheng)施工(gong)(gong)”違法行為(wei),切(qie)實強化(hua)工(gong)(gong)程質量(liang)安(an)全監管(guan),依據《中華人民共和(he)國建筑(zhu)法》《建筑(zhu)工(gong)(gong)程施工(gong)(gong)許可管(guan)理辦法》《湖北(bei)省建筑(zhu)市場管(guan)理條例》,現就進一步(bu)加強房屋建筑(zhu)和(he)市政工(gong)(gong)程施工(gong)(gong)許可管(guan)理通知(zhi)如下:

一、充分認識辦(ban)理施工(gong)許可的(de)重要性

依(yi)(yi)法辦理(li)施工(gong)(gong)許(xu)可(ke)證(zheng)是(shi)規范房(fang)屋建(jian)(jian)筑(zhu)和市(shi)政工(gong)(gong)程(cheng)基(ji)本(ben)建(jian)(jian)設程(cheng)序,維護建(jian)(jian)筑(zhu)市(shi)場秩序,保證(zheng)工(gong)(gong)程(cheng)質量安全的(de)根(gen)本(ben)條件。住建(jian)(jian)主管(guan)部門要(yao)進(jin)一(yi)(yi)步強化責任意識,充分認(ren)識施工(gong)(gong)許(xu)可(ke)制度的(de)重(zhong)要(yao)性,切實增強依(yi)(yi)法行政的(de)自覺性,確保施工(gong)(gong)許(xu)可(ke)辦理(li)工(gong)(gong)作規范有序開展(zhan)。建(jian)(jian)設單位(wei)在未取得(de)施工(gong)(gong)許(xu)可(ke)證(zheng)前,一(yi)(yi)律不(bu)得(de)組織項目開工(gong)(gong),不(bu)得(de)以招商引資、營商環(huan)境(jing)等名義或通過分解工(gong)(gong)程(cheng)等方式,規避辦理(li)施工(gong)(gong)許(xu)可(ke)證(zheng);施工(gong)(gong)總承包(bao)單位(wei)在施工(gong)(gong)許(xu)可(ke)證(zheng)核發前,一(yi)(yi)律不(bu)得(de)進(jin)場施工(gong)(gong)。

二(er)、優(you)化施工許(xu)可審批

各(ge)級(ji)住(zhu)建(jian)主管部門(men)(men)要(yao)把加強施工(gong)(gong)(gong)(gong)許可(ke)審(shen)批(pi)(pi)服務,提高審(shen)批(pi)(pi)效率作為(wei)推進項(xiang)目開(kai)工(gong)(gong)(gong)(gong)建(jian)設、優化(hua)營商環境(jing)、促(cu)進建(jian)筑業發展的(de)具(ju)體體現。相關(guan)住(zhu)建(jian)、城(cheng)管、行政審(shen)批(pi)(pi)等部門(men)(men)要(yao)按照工(gong)(gong)(gong)(gong)程(cheng)建(jian)設項(xiang)目審(shen)批(pi)(pi)制度改革要(yao)求,建(jian)立施工(gong)(gong)(gong)(gong)許可(ke)審(shen)批(pi)(pi)與(yu)監管協同機制,形(xing)成(cheng)施工(gong)(gong)(gong)(gong)過程(cheng)管控合力,確保工(gong)(gong)(gong)(gong)程(cheng)質量安全。

(一)優(you)化房屋建筑工(gong)程施(shi)工(gong)許可(ke)審批

1.分(fen)(fen)階段辦理(li)(li)施(shi)工(gong)(gong)許(xu)可(ke)。依據《關(guan)于進一步優化辦理(li)(li)施(shi)工(gong)(gong)許(xu)可(ke)的(de)通知》(鄂(e)建(jian)設(she)規〔2024〕6號(hao)),房屋建(jian)筑工(gong)(gong)程的(de)建(jian)設(she)單位(wei)可(ke)根據施(shi)工(gong)(gong)需要,將項目分(fen)(fen)為“基坑支護及(ji)土(tu)石方”“主體(ti)(ti)工(gong)(gong)程底板(ban)以下(不(bu)含(han)底板(ban))”“主體(ti)(ti)工(gong)(gong)程底板(ban)以上”三個階段辦理(li)(li)施(shi)工(gong)(gong)許(xu)可(ke)證。

2.落實施(shi)工(gong)許(xu)可(ke)辦理條件(jian)替(ti)代機(ji)制。依據《關于(yu)進一步優化辦理施(shi)工(gong)許(xu)可(ke)的通知》(鄂建設(she)(she)規(gui)(gui)〔2024〕6號),辦理房屋(wu)建筑(zhu)工(gong)程施(shi)工(gong)許(xu)可(ke)證(zheng)時,建設(she)(she)單位可(ke)用土地(di)劃(hua)(hua)撥決定書(shu)、國(guo)有建設(she)(she)用地(di)成交確(que)認書(shu)、國(guo)有建設(she)(she)用地(di)使用權出讓合同、不動產權證(zheng)其一替(ti)代建設(she)(she)工(gong)程用地(di)批準手續,可(ke)用規(gui)(gui)劃(hua)(hua)部門出具的規(gui)(gui)劃(hua)(hua)條件(jian)文書(shu)替(ti)代建設(she)(she)工(gong)程規(gui)(gui)劃(hua)(hua)許(xu)可(ke)證(zheng)。

(二)優化市(shi)政工程(cheng)施(shi)工許可審(shen)批

1.分(fen)段(duan)(duan)辦(ban)(ban)理施(shi)(shi)(shi)(shi)工(gong)許(xu)(xu)(xu)可(ke)(ke)。市(shi)政工(gong)程(cheng)(cheng)(cheng)的(de)建(jian)設(she)(she)(she)單位(wei)可(ke)(ke)按(an)(an)地(di)上(shang)部分(fen)、地(di)下部分(fen)、工(gong)程(cheng)(cheng)(cheng)項(xiang)目(mu)類別和建(jian)設(she)(she)(she)條件合理劃分(fen)施(shi)(shi)(shi)(shi)工(gong)區間,按(an)(an)標(biao)段(duan)(duan)、里程(cheng)(cheng)(cheng)、樁號(hao)分(fen)段(duan)(duan)(或(huo)(huo)部位(wei))辦(ban)(ban)理施(shi)(shi)(shi)(shi)工(gong)許(xu)(xu)(xu)可(ke)(ke)證。采用分(fen)段(duan)(duan)方式辦(ban)(ban)理施(shi)(shi)(shi)(shi)工(gong)許(xu)(xu)(xu)可(ke)(ke)證的(de)市(shi)政工(gong)程(cheng)(cheng)(cheng),在(zai)規劃方案設(she)(she)(she)計環(huan)節,建(jian)設(she)(she)(she)單位(wei)須(xu)一(yi)次性完成(cheng)項(xiang)目(mu)整體設(she)(she)(she)計,并(bing)按(an)(an)照整體方案進行(xing)規劃審(shen)查(cha)(cha)(cha);在(zai)施(shi)(shi)(shi)(shi)工(gong)圖(tu)(tu)審(shen)查(cha)(cha)(cha)環(huan)節,須(xu)委托同一(yi)家施(shi)(shi)(shi)(shi)工(gong)圖(tu)(tu)審(shen)查(cha)(cha)(cha)機構(gou)分(fen)段(duan)(duan)完成(cheng)施(shi)(shi)(shi)(shi)工(gong)圖(tu)(tu)審(shen)查(cha)(cha)(cha)。施(shi)(shi)(shi)(shi)工(gong)圖(tu)(tu)審(shen)查(cha)(cha)(cha)合格意見書及施(shi)(shi)(shi)(shi)工(gong)許(xu)(xu)(xu)可(ke)(ke)證上(shang)應以(yi)單位(wei)工(gong)程(cheng)(cheng)(cheng)或(huo)(huo)分(fen)部工(gong)程(cheng)(cheng)(cheng)的(de)坐(zuo)標(biao)、樁號(hao)、里程(cheng)(cheng)(cheng)號(hao)等形式注明分(fen)段(duan)(duan)情(qing)況。

2.優(you)化施(shi)工許(xu)(xu)可辦理條(tiao)件(jian)替代機制。辦理市(shi)政(zheng)工程施(shi)工許(xu)(xu)可證(zheng)(zheng)時,建設(she)單(dan)位可用(yong)以下材(cai)料替代用(yong)地批準手續、工程規劃許(xu)(xu)可證(zheng)(zheng)、施(shi)工圖審查合格意見(jian)書。

以(yi)劃撥方式供地(di)(di)的(de)(de),可(ke)以(yi)用(yong)(yong)用(yong)(yong)地(di)(di)預審意(yi)見與選(xuan)址意(yi)見書(shu)(含用(yong)(yong)地(di)(di)規(gui)(gui)劃紅線圖(tu)(tu))、用(yong)(yong)地(di)(di)批(pi)復文件、國(guo)有建(jian)(jian)(jian)設(she)(she)(she)用(yong)(yong)地(di)(di)劃撥決定(ding)書(shu)、建(jian)(jian)(jian)設(she)(she)(she)用(yong)(yong)地(di)(di)規(gui)(gui)劃許(xu)可(ke)證(zheng)(zheng)、不動(dong)產(chan)(chan)使(shi)用(yong)(yong)權證(zheng)(zheng)其(qi)一(yi)作為用(yong)(yong)地(di)(di)批(pi)準手(shou)續辦理施(shi)工許(xu)可(ke)證(zheng)(zheng)。以(yi)出(chu)(chu)讓(rang)(rang)方式供地(di)(di)的(de)(de),可(ke)以(yi)用(yong)(yong)成交確認書(shu)、出(chu)(chu)讓(rang)(rang)合同、建(jian)(jian)(jian)設(she)(she)(she)用(yong)(yong)地(di)(di)規(gui)(gui)劃許(xu)可(ke)證(zheng)(zheng)、不動(dong)產(chan)(chan)使(shi)用(yong)(yong)權證(zheng)(zheng)其(qi)一(yi)作為用(yong)(yong)地(di)(di)批(pi)準手(shou)續辦理施(shi)工許(xu)可(ke)。不涉及新(xin)增建(jian)(jian)(jian)設(she)(she)(she)用(yong)(yong)地(di)(di)的(de)(de)項目,可(ke)以(yi)用(yong)(yong)自然資源和(he)城(cheng)鄉建(jian)(jian)(jian)設(she)(she)(she)部門出(chu)(chu)具的(de)(de)用(yong)(yong)地(di)(di)規(gui)(gui)劃紅線圖(tu)(tu)和(he)無新(xin)增建(jian)(jian)(jian)設(she)(she)(she)用(yong)(yong)地(di)(di)證(zheng)(zheng)明材料(liao)作為用(yong)(yong)地(di)(di)批(pi)準手(shou)續辦理施(shi)工許(xu)可(ke)證(zheng)(zheng)。

可以用經批準的建設(she)工(gong)(gong)(gong)(gong)程(cheng)設(she)計方案成(cheng)果審(shen)(shen)查(cha)意見代替工(gong)(gong)(gong)(gong)程(cheng)規劃許(xu)可證辦理施工(gong)(gong)(gong)(gong)圖審(shen)(shen)查(cha)和施工(gong)(gong)(gong)(gong)許(xu)可證。屬于工(gong)(gong)(gong)(gong)程(cheng)規劃許(xu)可豁免清單范圍(wei)的,可以自(zi)然資源和城(cheng)鄉建設(she)部門出具的工(gong)(gong)(gong)(gong)程(cheng)規劃許(xu)可證豁免證明代替工(gong)(gong)(gong)(gong)程(cheng)規劃許(xu)可證辦理施工(gong)(gong)(gong)(gong)圖審(shen)(shen)查(cha)和施工(gong)(gong)(gong)(gong)許(xu)可證。

可以用施工(gong)(gong)圖(tu)技術性(xing)審(shen)(shen)(shen)查(cha)合(he)格意(yi)見(jian)代替施工(gong)(gong)圖(tu)審(shen)(shen)(shen)查(cha)合(he)格意(yi)見(jian)書(shu)辦理(li)施工(gong)(gong)許可證。施工(gong)(gong)圖(tu)審(shen)(shen)(shen)查(cha)機構可依據經批準的(de)建(jian)設工(gong)(gong)程設計方(fang)案成果審(shen)(shen)(shen)查(cha)意(yi)見(jian)或用地規(gui)劃紅線(xian)圖(tu)(僅限(xian)不涉及新增用地和新增建(jian)筑面積的(de)項目),出具技術性(xing)審(shen)(shen)(shen)查(cha)意(yi)見(jian),技術性(xing)審(shen)(shen)(shen)查(cha)意(yi)見(jian)須詳細標注項目分段信息。

(三)明確材料補正時限(xian)

以(yi)替代方式取(qu)得(de)施工(gong)許可證的房屋(wu)建筑和(he)市政工(gong)程,應在聯合驗收(shou)前取(qu)得(de)用(yong)地、規劃(hua)相關(guan)許可和(he)施工(gong)圖審查合格意(yi)見書(shu)。

三、加強施工(gong)許可監(jian)管(guan)

(一)壓實監管責任

各級住建(jian)(jian)主管(guan)部門要(yao)認真落實施(shi)工(gong)許(xu)可(ke)(ke)辦理(li)各項要(yao)求,把高(gao)(gao)效辦理(li)施(shi)工(gong)許(xu)可(ke)(ke)、持續開展(zhan)“無證施(shi)工(gong)”專(zhuan)項整(zheng)(zheng)治作為工(gong)程(cheng)質量(liang)安全(quan)風險防(fang)控的(de)重要(yao)抓手。各地不(bu)得以(yi)屬地重點工(gong)程(cheng)、三區(qu)工(gong)程(cheng)(開發區(qu)、高(gao)(gao)新區(qu)、工(gong)業園區(qu))等(deng)理(li)由(you)允許(xu)房屋建(jian)(jian)筑和市政(zheng)工(gong)程(cheng)在未(wei)取得施(shi)工(gong)許(xu)可(ke)(ke)證的(de)情況下開工(gong)建(jian)(jian)設。要(yao)切實加強審批服務,通過宣貫(guan)分(fen)段辦理(li)和替代豁免政(zheng)策,督促建(jian)(jian)設單位及時(shi)整(zheng)(zheng)改等(deng)方(fang)式,破(po)解施(shi)工(gong)許(xu)可(ke)(ke)“辦不(bu)了”、違法建(jian)(jian)設“管(guan)不(bu)住”問(wen)題。

(二)加強動態監管

各級(ji)住建主(zhu)管部門(men)要提升信(xin)息化監(jian)管水平,運用系統平臺實時(shi)比對(dui)混凝土配送、衛(wei)片圖斑、施(shi)工許可證核發等(deng)數(shu)據信(xin)息,對(dui)“無證施(shi)工”項目實時(shi)進行排查。在開展建筑市場(chang)與施(shi)工現場(chang)“兩場(chang)聯動”時(shi),要及時(shi)發現違法(fa)線(xian)索,堅決遏制新建項目“無證施(shi)工”問題。

(三)嚴格依法查處

對(dui)房(fang)屋建(jian)筑和市政工程“無證施工”項目要嚴(yan)格依(yi)法(fa)(fa)依(yi)規實(shi)施行政處罰。各地在監管執法(fa)(fa)過程中,要通過集中通報、“黑榜”公(gong)示等方式,曝光一(yi)批違(wei)法(fa)(fa)施工項目、違(wei)規建(jian)設、施工單(dan)位典型(xing)案(an)例,達到警示促改效(xiao)果。省廳將建(jian)立常態化指導(dao)幫扶機制,對(dui)查處“無證施工”問題不力的地區進行重點督導(dao)。

本(ben)通知(zhi)自印發之日起試行,有效期2年(nian)。
